Several insurance companies have already had lawsuits filed against them based on their denial of claims under business interruption policies arising out of COVID-19. The cases involving what constitutes “physical damage” are already being litigated, and experts are predicting unprecedented interpretations and arguments that may expand coverage for the present and future pandemics.
